Up Periscope, Get a Good Look at Offshore Income and High Asset Divorce Taxation
Daniel J. Jaffe and Christopher C. Melcher will explore the shifting minefields of tax issues that can affect parties with income from multinational sources when setting support. They will also discuss the evolving reporting requirements for offshore assets and how those rules can be used to discover offshore accounts. Potential tax penalties regarding offshore accounts will be addressed, which may be relevant to how those assets may need to be divided in a divorce. Dan and Chris will also consider whether there are tax withholding requirements when setting spousal support, alimony or maintenance for a party who is a nonresident alien. They will also discuss how to divide property in a divorce when one party is a nonresident alien, since gain or loss must be recognized on those transactions.

He is a Fellow in the American Academy of Matrimonial Lawyers and is a Certified Family Law Specialist. Chris focuses his practice on complex family law litigation and the preparation of premarital agreements. He is the Chair of the California State Bar Family Law Section of the 2011-2012 term.
