What Family Law Attorneys Need To Know About the U.S. Supreme Court Marriage Equality Decisions

On June 26, 2013, the United States Supreme Court issued landmark Civil Rights decisions on two Marriage Equality cases, US v. Windsor (DOMA) and Hollingsworth v. Perry (California Proposition 8). This webinar's purpose is to assist the practitioner in navigating the myriad of Federal programs and benefits affected by the repeal of Section 3 of the Defense of Marriage Act in Family Law related topic areas such as adoption, life insurance and health care benefits, HIPPA, COBRA, ERISA covered retirement plans, custody, immigration including spouse visa applications, income taxation, estate planning, pre-marital agreements, and social security. We will grapple with the question of a court's jurisdiction to dissolve a marriage celebrated in a Marriage Equality jurisdiction while the parties live in a prohibition jurisdiction. Just as the country is divided up into a patchwork of red versus blue states, it is also divided up into a patchwork of Marriage Equality Jurisdictions (13) versus Prohibition states (38). Hear from experienced Family Law practitioners from each type of jurisdiction, and learn strategies to advise your clients depending upon the laws of your jurisdiction, as well as identifying some of the challenges and approaches to resolution of cases from these two distinct perspectives. The two landmark decisions represent a huge step forward toward Marriage Equality throughout the country—learn about other changes that may be on the near horizon as various states grapple with these issues in their state courts and legislatures, and hear about existing cases pending in various Federal District courts around the country. More change is coming.


Richard Roane
Richard Roane has practiced Family Law for 25 years, and chaired the practice group at Warner Norcross & Judd LLP for 5 years. He represents clients throughout the country and internationally in complex business valuation matters, custody, support, pre-nuptial agreements, change of domicile and choice of schools, and has handled dozens of non-marital and same sex relationship dissolution matters. He is a trained mediator, arbitrator and collaborative lawyer. Roane lectures and teaches attorneys and judges alike in a variety of Continuing Legal Education forums and programs, and is a chapter author and co-editor of Michigan Family Law, 7th Edition (ICLE 2011). He chairs the AAML LGBT/Alternative Family Committee.
Diana Richmond
Diana Richmond, a family law partner at Sideman & Bancroft LLP, has authored amicus briefs for AAML on marriage equality in Hollingsworth v. Perry, the California Marriage Cases, and the Iowa marriage case of Varnum v. Brien. She has been continuously listed in Best Lawyers in America from its inception in 1983, and has been listed as its Attorney of the Year in family law or mediation several times. She writes and lectures widely on family law issues.


Peter M. Walzer
Peter M. Walzer is the founding partner of the Southern California law firm Walzer & Melcher LLP, Los Angeles, California, which is focused exclusively on family law. Peter is on the Council of the Family Law Section of the American Bar Association. He is a past president of the Southern California Chapter of the American Academy of Matrimonial Lawyers and is a former chair of the executive committee of the State Bar Family Law Section. Mr. Walzer has been a Certified Family Law Specialist for 23 years and is a former president of the Association of Certified Family Law Specialists. He is chair-elect of the Los Angeles County Bar Association Family Law Section. Peter was named Person of the Year in 2009 by the Southern California Chapter of the American Academy of Matrimonial Lawyers. Peter was named Fellow of the Year by the American Academy of Matrimonial Lawyers in 2010.. Peter is a vice-president of the American Academy of Matrimonial Lawyers. and
